An authorized representative for I-9 is any person an employer selects to complete Section 2 of Form I-9 on their behalf.
Employers are required to complete an I-9 for every employee, but with the rise of remote work, the in-person requirements for filling out Section 2 can be difficult. Authorized representatives help with this difficulty by completing Section 2 with the New Hire.
Oftentimes, authorized representatives are selected for their proximity to a New Hire, making it easy to meet and complete the I-9 together. But who can be an authorized representative for I-9s?
Who Can Be an Authorized Representative for I-9?
Pretty much anybody can act as an employer’s authorized representative for I-9s, but don’t take our word for it (seriously, never take anybody’s word for anything when it comes to compliance—do your own research!). Here are the current guidelines as outlined on the UCIS website.
It is extremely important for employers to recognize, however, that they remain responsible for any errors made by their authorized representative. If the I-9 is not filled out correctly, for whatever reason, the employer is out of compliance. Period. It does not matter if somebody else, like an authorized representative, filled out the I-9. It’s the employer’s responsibility and liability.
This is why, when choosing authorized representatives, it is imperative that employers choose wisely. This isn’t a job for anybody, and not everybody in the business is as careful as they should be.
